Terms of Use

The Medical University of South Carolina (MUSC) Online Alumni Portal and Directory is for MUSC only, and it exists to foster individual communication between alumni. It is for non-commercial purposes only. Use of the directory for any other purpose, including, but not limited to, reproducing and storing in a retrieval system by any means, electronic or mechanical, photocopying, or using the addresses or other information contained in this directory for any private, commercial, business promotion, or political mailing is strictly prohibited. Users who violate these terms will have their access rights revoked.

Introduction

The Medical University of South Carolina Alumni Association's Online Alumni Portal and Directory ("Portal") and this web site http://connect2.musc.edu/portal ("Site") are owned by the Medical University of South Carolina. This Portal is an online directory intended to promote and enhance communication of a personal nature between members of the Medical University of South Carolina Alumni Association, as well as, the Medical University of South Carolina staff, faculty, students and emeriti who are registered users of the Portal ("Users"). This Terms of Use Agreement ("Agreement") establishes the terms and conditions pursuant to which you may access and use the Portal, and constitutes a binding agreement between you and the Medical University of South Carolina. By creating an account and logging in, you acknowledge that you have read and agree to the Medical University of South Carolina Online Alumni Portal and Directory Terms of Use and you acknowledge that you are entering into a legally binding agreement with the Medical University of South Carolina and the Medical University of South Carolina Alumni Association. Violation of these terms may result in the termination of access to this Portal. Please report misuse to the Alumni Affairs Office.

USER AGREEMENT:

Usernames, Passwords, and Directory Use

This Portal is password protected. You are entirely responsible for maintaining the confidentiality of your username and password. The Medical University of South Carolina has no way to know, and will not be responsible, if someone other than you accesses this Portal using your username and password. You are entirely responsible for any use or misuse of this Portal by anyone using your username and password.

As a condition for your use of the Medical University of South Carolina Online Alumni Portal and Directory, you agree that you will not:

• use this Portal for any unlawful purpose including, but not limited to, forging information, impersonating other people, contributing information which you know to be false, or misrepresenting your affiliation with any person or entity;
• use this Portal for commercial purposes; for the benefit of any for-profit or not-for-profit business or organization (other than the Medical University of South Carolina); for academic research; for political, religious, or charitable solicitations of any kind; or for any other purpose other than to maintain and strengthen your relationship with other alumni and the Medical University of South Carolina;
• use this Portal for purpose of threatening, abusing, "stalking," harassing, defaming, harming, or offending any person or persons in any way; or for the purpose of invading the privacy of another; or for a purpose that may, in any manner, be considered objectionable (e.g., racist, vulgar, etc.) to other Users;
• upload, e-mail, post or otherwise send or transmit any content which you do not have a right to transmit under any law or under contractual or fiduciary relationship (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationship, or under nondisclosure agreements);
• infringe, misappropriate or otherwise violate any existing national or international copyright, trademark, service mark, trade name, or other intellectual property or proprietary rights of any person or entity whatsoever;
• give your password to anyone, use this Portal as the agent of a third party, or allow any third party to use your account;
• violate any other terms or conditions contained in this Agreement.

The Medical University of South Carolina, in its sole and absolute discretion, shall determine whether any information transmitted, collected, or received, violates these rules. The Medical University of South Carolina has the right (but not the obligation) to refuse to post, or to remove, any information or content, in whole or in part, that is objectionable or in violation of this Agreement.

Registration and Privacy

Each User must register and agree to this Agreement to access and use this Portal. Your registration and use of this Portal constitutes your acceptance of these terms and conditions. Your use of this Portal and the Site will at all times be subject to and pursuant to this Agreement.

You can update and correct your profile and designate the information that will be displayed to others by making the changes and corrections to the online profile.

You agree that, unless and until you modify your profile or notify the Medical University of South Carolina Alumni Affairs Office that you wish us to delete your Online Profile, the Medical University of South Carolina may continue to publish your Profile in this Portal and Directory. If you wish to delete your Profile from this Portal and Directory, you must provide written notice to the Medical University of South Carolina.

Termination

You agree that the Medical University of South Carolina, in its sole discretion, may terminate your access to this Portal and remove or discard any of your Profile information for any reason including, but not limited to, the Medical University of South Carolina's belief that you have violated or acted inconsistently with the letter or spirit of this Agreement. You agree that any termination of your access to this Portal may occur without your prior knowledge. You further agree that the Medical University of South Carolina shall not be liable to you or any third party for any termination of your access to this Portal.

Disclaimer of Warranties and Limitation of Liability

The Medical University of South Carolina desires to provide services of value to its Users. All information on our Site is posted for your convenience only and we make no representations or warranties concerning its accuracy. It also is important for you to keep in mind that this Site and our Portal are run on software, hardware, and networks, any component of which may require maintenance or experience problems from time to time. We make no promises as to the continued availability or the functionality of this Site or our Portal.

You agree that use of the Portal, including the Site, is at your sole risk and that the information contained herein is provided to you "as is," and "as available" for your informational purposes only. To the maximum extent allowed by applicable law, the Medical University of South Carolina expressly disclaims all representations and warranties of any kind in connection with the Portal, the site, or any other web site linked to the site, whether such warranties are express or implied by law, custom or otherwise, including any warranty of merchantability, satisfactory quality, fitness for a particular purpose, performance, informational content, accuracy and system integration.

The Medical University of South Carolina disclaims any responsibility for the deletion, failure to store, or untimely delivery of any information or material. Any material downloaded or otherwise obtained through the use of the Portal is done at your own discretion and risk, and you will be solely responsible for any damages to your computer system or loss of data that results in the download of such material.

In no event shall the Medical University of South Carolina, nor its respective directors, officers, employees, or agents, be liable to you or any other party for any money damages or other liability whatsoever arising out of or in connection with this agreement or the Portal, including lost profits or any direct, indirect, special, incidental or consequential damages. You agree that neither The Medical University of South Carolina, nor its respective directors, officers, employees, or agents, shall be liable for any defamatory, offensive, or illegal conduct of any member.

Solely as a courtesy to you, we may provide links to third party web sites and resources that are beyond our control. We do not endorse, approve, certify, or control any of those sites, and because we do not have any control over them, you acknowledge and agree that we are not responsible for their content or the availability, accuracy, completeness, efficacy, or timeliness of information contained on them. Reference on those sites to any commercial product, process, or service by trade name, trademark, service mark, manufacturer, or otherwise does not constitute or imply endorsement, recommendation, or favoring by the Medical University of South Carolina. The Medical University of South Carolina accepts no responsibility for the privacy practices of such web sites. You hereby waive any claim, present or future, you may have against the Medical University of South Carolina with respect to such web sites.

Under no circumstances shall the Medical University of South Carolina be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control. The limitations of liability and disclaimers herein shall apply regardless of the form of action, whether in contract, warranty, strict liability, negligence, and shall survive a fundamental breach or breaches of contract, or the failure of the essential purpose of this Agreement.
